ON-LINE DISPUTE RESOLUTION (ODR) IN AFRICA

"ODR aims to make every mobile phone a point of access to justice, with algorithms dynamically directing cases toward hundreds or thousands of virtual doors available to fit each disagreement to a specifically crafted and appropriate forum for resolution"

The mobile phone is ubiquitous in Nigeria. Since the year 2000 when mobile phones were introduced in the country, the proliferation of same has been phenomenal. What with every other artisan carrying one. At the hairdresser's, the client's time is eaten into by frivolous phone calls by the stylist. Sometimes, an artisan, who is usually paid on a daily basis spends a considerable amount of time he/she should have spent doing your work on the phone, and you still have to pay the agreed amount!

Could machines communicate and negotiate in a positive and empathic way? This is the realm of Artificial Intelligence (AI), which many discerning practitioners have embedded in their work. Remember: Garbage in, garbage out - It's what you feed into the machine that determines its output.  How can we key into the availability of the mobile phone, the internet, Skype, etc to advance ODR on the continent of Africa? There is a list of relevant criteria that the ODR platform should meet:

1) The platform should be accessible to the disputants and the Mediator.
2) The process should not be too complicated for the parties to understand.
3) In Africa, we should be conscious of internet access.
4) The time zones should be noted, even within Africa.
5) The platform should be certified secure enough for all the parties to feel safe to speak under 'Chattam House' rules.

The foregoing criteria are not exhaustive, and seem to constitute a tall order in Africa, but we'll get there! What about race relations between & among the disputants, not ignoring their psychological state. In this era of multiple intra-state conflicts on the continent, the socio-ecological analysis of contemporary conflicts in the relevant clime and how they could affect the particular Mediation process should be taken into consideration. Am I delving into the realm of neuro-science? Does anyone share my optimism in this gargantuan task of pulling together mediation, arbitration, neuro-science and other methods of dispute/conflict resolution to aid ODR in Africa?
