ALTERNATIVE DISPUTE RESOLUTION (ADR)

While many perspectives of ADR abound, in essence, ADR is an alternative to the adversarial process that dominates litigation in the courts and justice systems. ADR uses such techniques as arbitration, mediation and negotiation in an attempt to resolve disputes. In other words, ADR is a non-coercive alternative to the legal system that uses third party interveners. For many, it is seen as a more humane version of the legal system.

But some argue that it is really the court system that should be viewed as the alternative to ADR. They say that in Africa, for example, ADR preceded the courts. When elders preside over a matter and "resolve" same, they are engaging in ADR.

Which came first? The egg or the chicken? Did ADR precede the courts, or is it the other way round?

If we look way back in time, informal systems and extended families were the order of the day. With the growth and evolution of society, formal systems, including legal procedures courts, gradually took the stage. Often, the pendulum swung to far toward bureaucratic rules and procedures. As such, there is often a movement to re-introduce the more traditional systems as a complement to the more "modern" ones. And the cycle continues in most fields in order to find a happy medium as the needs of people and society evolve.

@Ralph, many thanks for your comment. I agree with your perspective. In modern times, when the complexity of society has entrenched the phenomenon of anomie, it has become necessary to put "law and order", which includes the courts on the front burner. But in many parts of Africa, the question is being often asked: Didn't we have less adversarial traditional methods of resolving disputes where there is a "win-win" situation and not "winner takes all"? The latter is the case with the courts, while the former rears its pleasant antennae in the traditional methods of conflict transformation. These traditional methods seem to PRESERVE relationships rather than destabilize same. I join Ralph and others in the search for the "happy medium" between these two methods of transforming conflicts.

As Ralph has mentioned above (an in my own words), it is about how the egg evolved in to a chicken, where the "egg" is the more non-isolated systems of dispute resolution and the "chicken" is the modern day courts systems with all their rules and all that. The non-isolated systems of dispute resolution based on traditional social systems and the modern courts systems are different only in the sense that one is more structured than the other. And the the fact that they both exist, especially within the African social context is true. The concept of ADR is therefore a kind of modernism that tries to make sense of the existence of concepts that are far removed from the adjudication character of the modern day courts systems, of which they are the most popular concepts of dispute resolution in the more informal, less isolated dispute resolution systems available to us in modern times.

@Kopep. It is quite good that the traditional African methods of conflict resolution exist alongside the courts. But the former is being labeled ADR. Some say it is the courts and the totality of the formal legal system that should be labeled ADR and not the other way round. The debate continues.
